These Terms of Service (“Terms”) govern your access to and use of the Digital Three Eleven website (“Website”) and any services provided by Digital Three Eleven (“Digital Three Eleven,” “we,” “us,” “our,”or “I”). By accessing this Website, submitting an inquiry, signing a proposal, or purchasing services, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Website or services.
Services Offered
Digital Three Eleven provides digital consulting and implementation services for small businesses, including website setup, technical configuration, and related services. All services are offered on a project-based, fixed-scope basis as described on the Website, in proposals, or in written agreements.
Only the services explicitly listed as included in a package, proposal, or agreement are covered. Any additional services, revisions beyond scope, or changes requested after work has begun must be agreed to in writing and may require additional fees.
No Ongoing Obligation
Unless explicitly stated in writing, Digital Three Eleven does not require ongoing subscriptions, retainers, or long-term service commitments. Clients retain ownership of their websites, domains, accounts, and any third-party subscriptions used as part of the engagement.
Client Responsibilities
Clients agree to provide accurate, complete, and timely information, including content, assets, approvals, and access to required third-party platforms. Clients are responsible for reviewing deliverables promptly and providing consolidated feedback.
Delays caused by missing information, delayed approvals, or lack of access may extend timelines and are not the responsibility of Digital Three Eleven.
Payments and Fees
Pricing for services is displayed on the Website or outlined in proposals or invoices. All fees are due as stated. Payments are non-refundable once work has commenced, unless otherwise agreed in writing.
Digital Three Eleven reserves the right to pause work or withhold deliverables in the event of non-payment.
Third-Party Platforms and Services
Digital Three Eleven configures and integrates services using third-party platforms selected for suitability for small businesses. These platforms may include website builders, email providers, AI tools, payment processors, or other services.
Third-party subscriptions, licenses, and usage fees are not included unless explicitly stated. Clients are responsible for maintaining their own third-party accounts and complying with applicable terms and policies. Digital Three Eleven does not control third-party pricing, availability, uptime, security practices, or policy changes.
AI-Assisted Tools
Where applicable, Digital Three Eleven may configure or support AI-assisted tools, including AI reception or content drafting. AI-generated outputs are based on client-provided inputs and automated systems.
Digital Three Eleven does not guarantee the accuracy, completeness, or suitability of AI-generated content or responses and is not responsible for decisions made based on automated outputs. Clients are responsible for reviewing and approving AI-assisted materials before use.
Content and Intellectual Property
Clients retain ownership of all content they provide, including text, images, logos, and trademarks, and represent that they have the legal right to use such content.
Upon full payment, clients are granted the right to use the final deliverables for their business purposes. Digital Three Eleven retains the right to display completed work in portfolios, case studies, or marketing materials unless otherwise requested in writing.
Content Scope
Unless explicitly included in writing, copywriting, content strategy, SEO content development, blog writing, and AI-generated content creation are not included in standard service packages and must be scoped separately.
Revisions
Revisions are limited to those outlined in the selected package or proposal. Revisions are intended to refine agreed-upon work and do not include new features, pages, or strategic changes. Requests outside the agreed scope may require additional fees.
Post-Launch Support
Post-launch support is limited to the duration specified in the selected package and includes minor fixes and clarification related to the delivered work. Ongoing maintenance, updates, monitoring, or optimization are not included unless separately agreed upon.
Data Privacy
Customer website data, including form submissions and site activity, is collected, stored, and secured by third-party platforms in accordance with their published privacy and security policies.
Digital Three Eleven configures services using standard, secure platform settings but does not independently store, sell, or process customer website data outside of third-party platform environments. Digital Three Eleven is not responsible for third-party data breaches or security incidents.
No Guarantees
Digital Three Eleven does not guarantee search engine rankings, traffic levels, conversion rates, lead volume, revenue outcomes, or business performance. Results depend on factors outside our control, including market conditions, competition, and client operations.
Limitation of Liability
To the maximum extent permitted by law, Digital Three Eleven shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Website or services.
Digital Three Eleven’s total liability for any claim arising out of or related to services shall not exceed the amount paid by the client for the specific services giving rise to the claim.
Independent Contractor
Digital Three Eleven operates as an independent contractor. Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency relationship.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles.
Changes to These Terms
Digital Three Eleven reserves the right to update these Terms at any time. Continued use of the Website or services constitutes acceptance of the updated Terms.
